Employers will also be able to promptly and quickly deal with. 重庆出台劳动争议终局裁决新政 最快2个月解决   昨日,重庆晚报记者从市人社局获悉,我市出台《关于劳动争议终局裁决适用有关事项的通知》,进一步明确劳动争议仲裁终局裁决的适用范围和程序,今后劳动争议处理最快2个月内完成。   弥补法律不完善漏洞   据了解,目前劳动争议处理以一裁两审为主要处理机制,即发生劳动争议后,当事人应当先向劳动人事争议仲裁委员会申请仲裁,对仲裁裁决不服的,双方当事人均可向基层人民法院起诉,再不服的,可向中级人民法院上诉。同时,以仲裁委员会一裁终局为补充。   根据《中华人民共和国劳动争议调解仲裁法》,一裁终局指以下两种情况劳动争议,可以直接由劳动仲裁委作出判决定纷止诉:第一,追索劳动报酬、工伤医疗费、经济补偿或者赔偿金,不超过当地月最低工资标准十二倍金额的争议;第二,因执行国家的劳动标准在工作时间、休息休假、社会保险等方面发生的争议。   市人社局相关负责人表示,由于法律规定相对原则,具体标准不够细化,实践中,一部分标的小、案情简单的案件,未纳入终局裁决的范围。同时个别用人单位也存在恶意拖延办案周期的情况,导致劳动争议并未取得定纷止诉的效果,一些劳动者的合法权益长时间得不到保护。   市人社局相关负责人表示,《通知》出台之前,部分企业利用法律不完善的漏洞,延长争议案件审理期限,拖垮劳动者。部分企业通常在劳动人事争议仲裁委员会仲裁期间,故意不拿出对自己有利的关键证据,得到一个劳动者有利的仲裁结果。然后不服判决,向基层人民法院提起诉讼,失败后再向中级人民法院上诉。在这个过程中,至少会耗费劳动者1年以上时间,多的会耗费两三年,劳动者自然而然地就被拖垮了,最后妥协让利接受调解。   新政10月15日起生效   此次市人社局出台的《通知》,在原有法律基础上,进一步明确了劳动争议适用终局裁决的范围,包括细化有关劳动报酬的劳动争议案件、将有关工伤医疗费等劳动争议案件纳入终局裁决之中,大大缩短了劳动争议处理期。以后,各类劳动争议案件有望在两个月内处理完毕。   市劳动人事争议仲裁机构负责人介绍,随着近年来我市经济的高速增长,全市劳动人事争议案件量也呈增长趋势,去年全市仲裁机构共立案处理劳动人事争议案件4万余件,今年上半年立案处理2.8万件。《通知》出台后,预计25%以上的劳动争议案件将得到快速解决,利益受损的劳动者有望尽快得到补偿。用人单位也将能及时快速处理用工争议,降低诉讼成本,恢复正常管理秩序。   《通知》从今年10月15日起生效,届时没处理完成的劳动争议案件将按照新颁布的通知内容进行受理。   不增加当事人成本   据了解,劳动人事争议仲裁委员会对终局裁决所有案件不收费。   实行终局裁决后受理案件时,发现申请人的仲裁请求中有符合终局裁决事项的,可将终局裁决与非终局裁决事项分别立案受理,在受理通知文书中分别载明申请人仲裁请求的受理事项及另分案处理事项。   分别立案受理不会增加当事人负担,当事人无需重新提交或增加申请书及相关材料的副本。仲裁委员会认为有需要,可自行复制增加并交申请人确认即可。   企业不服裁决没办法拖   据介绍,《通知》出台后,劳动人事争议仲裁委员会针对适用一裁终局的6类案件作出的裁决,劳动者不服的,仍可向人民法院起诉。用人单位不服的,如果有证据证明裁决存在适用法律法规确有错误、劳动人事争议仲裁委员会无管辖权、违反法定程序、裁决所根据的证据是伪造的、对方当事人隐瞒了足以影响公正裁决的证据的、仲裁员在仲裁该案时有索贿受贿、徇私舞弊、枉法裁决行为情形的,可以向仲裁委员会所在地的中级人民法院申请撤销。   “也就是说,今后企业不服裁决就没有拖的可能性了。”该负责人说,企业必须在劳动争议仲裁阶段就提供所有对自己有利的证据,这是让自己获得有利仲裁仅有的机会。由此,将大大缩短劳动争议案件处理周期,劳动者曾经需要打两三年官司才能讨要到的工资、工伤待遇等,今后可能在两个月内得到解决。   如果企业申请撤销,处理期限是3个月。也就是说,劳动人事争议仲裁委员会针对6类案件作出的裁决,最慢也将在半年以内得到最终结果。自裁决之日起,15日内必须执行。如果企业在15日内未执行裁决内容,劳动者可向法院申请强制执行。   明确了   6类劳动争议 适用一裁终局   (1)当事人追索计时计件工资、加班加点工资、奖金、津补贴等劳动报酬,单项裁决金额不超过当地月最低工资标准12倍的争议。   (2)当事人追索工伤医疗费,裁决金额不超过当地月最低工资标准12倍的争议。   (3)当事人追索解除终止劳动合同的经济补偿、竞业限制经济补偿等经济补偿,单项裁决金额不超过当地月最低工资标准12倍的争议。   (4)当事人追索违法解除终止劳动合同赔偿金、未订立书面劳动合同的2倍工资差额等赔偿金,单项裁决金额不超过当地月最低工资标准倍的争议。   (5)劳动者请求用人单位支付养老保险、医疗保险、工伤保险、失业保险、生育保险待遇等因执行国家的劳动标准在社会保险方面发生的争议。   (6)当事人因执行劳动法律法规规章等规定的劳动标准,在工作时间以及法定节假日、休息日、年休假、产假、病假、探亲假、婚假、丧假等休息休假权利方面发生的争议。相关的主题文章:
